1. Who we are
"Surfroam" is the trading name and brand used for the connectivity services described on this website and in the Surfroam app. Unless a different contracting entity is clearly shown at checkout, on your invoice, or in your order confirmation, the service is provided and sold by Telecomer OÜ ("we", "us", "our").
These Terms govern your use of the Surfroam connectivity service and should be read together with our Privacy Policy, Refund & Cancellation Policy, Shipping & Delivery Policy, and Legal Notice.
2. Acceptance
By creating an account, placing an order, adding balance, activating a SIM or eSIM, or using the service, you accept these Terms. If you do not agree, do not use the service.
Nothing in these Terms removes any mandatory consumer right you have under the law of your country of residence that cannot be excluded by agreement. If these Terms conflict with such mandatory rights, the mandatory rights prevail.
3. The service
Surfroam is a data-only mobile connectivity service. It may be delivered through a physical SIM, an eSIM profile, a balance top-up, a prepaid package, or another Surfroam product or plan.
Unless expressly stated otherwise, the service does not include a phone number, voice calls, SMS, emergency calls, or access to local emergency services.
The service is for normal personal or business connectivity use. We grant you a personal, non-transferable right to use the service. You must not resell, sublicense, reverse-engineer, tamper with, or use the service unlawfully.
4. Account and device requirements
You must be at least 18 years old to buy or use the service. You are responsible for keeping your account, password, SIM, eSIM QR code, activation details, and device secure.
You are responsible for using a compatible, unlocked device and for setting it up correctly. This may include installing the correct SIM or eSIM profile, enabling data roaming, selecting the right mobile data line, and entering the correct APN where required.
If your SIM, eSIM, account, device, or credentials are lost, stolen, misused, or accessed without permission, contact us as soon as possible at support@surfroam.com.
5. Coverage, speed, and network limitations
Surfroam works through third-party mobile networks, roaming partners, internet infrastructure, and technical providers that we do not control. Coverage, speed, latency, routing, supported technologies, network availability, and access to specific operators may vary by country, location, device, radio conditions, local regulation, and network congestion.
We do not guarantee uninterrupted service, minimum speed, indoor coverage, 5G availability, access to a specific local network, or availability in every country, region, island, building, vessel, aircraft, remote area, or border zone.
Network partners, regulators, or technical providers may change, suspend, restrict, or withdraw coverage, tariffs, routing, or roaming availability. Where this happens, we may update our coverage, rates, or service availability accordingly.
6. Rates, charges, balance, and validity
Current rates, package details, taxes, validity periods, and product conditions are shown on the relevant product page, checkout page, account dashboard, rate page, or offer terms at the time of purchase. Rates and availability may change, but changes are not applied retroactively to charges already incurred.
Charges are deducted from your available balance or package allowance. Where both promotional credit and paid balance are available, promotional credit may be used first, unless stated otherwise.
Surfroam SIM and eSIM profiles do not automatically expire only because the balance is zero or a previous balance validity period has ended. Where technically and commercially supported, you may add new balance and continue using the same SIM or eSIM profile.
Balance, prepaid packages, promotional credit, bonuses, gift cards, trial credit, and plan validity have their own validity periods. The applicable validity period is shown on the relevant product page, checkout page, account dashboard, or offer terms at the time of purchase.
Adding an eligible balance or buying a new eligible plan may extend or reset validity as described for that product or offer. Expired balance, expired package allowance, promotional credit, bonuses, gift cards, and special offers are not refundable, except where mandatory law requires otherwise.
7. Billing disputes
If you believe a charge is incorrect, contact us at support@surfroam.com within 30 days of the charge, or within any longer period required by mandatory law. Please include your order number, account email, SIM/eSIM identifier if available, and a short explanation of the issue.
8. Fair usage
This Fair Usage section forms part of these Terms of Service.
The service is intended for normal personal and business use on personal devices and compatible equipment. You must not use it in ways that harm other customers, our systems, or the networks we use.
Prohibited use includes unlawful activity, fraud, abuse of promotions, tariff circumvention, excessive or abnormal use that unfairly affects other users, network scanning, spam, security attacks, unauthorized automated traffic, and machine-to-machine, IoT, fleet, router, gateway, or bulk deployment use unless covered by a suitable plan.
If you have a high-volume, IoT, M2M, fleet, crew, corporate, or router-based use case, contact us at support@surfroam.com. We may recommend a suitable plan or custom tariff.
We may review usage to protect the service. If we detect prohibited, fraudulent, abusive, abnormal, or unfair use, we may limit, throttle, suspend, terminate, or block the relevant session, plan, SIM, eSIM, account, or access to the service, and we may apply additional charges where appropriate. We act proportionately and give notice where practical, unless immediate action is needed to protect the network, other users, or the service.
9. Suspension and cancellation
You may stop using the service at any time. You may also ask us to close your account, subject to any records we must keep by law.
We may suspend, restrict, or cancel the service if you breach these Terms, misuse the service, provide false information, fail to pay, create risk for the service or other users, or use the service unlawfully or fraudulently.
We may close inactive accounts after a reasonable period of inactivity. Any remaining expired or promotional balance is not refundable, except where mandatory law requires otherwise.
10. Refunds, cancellation, and delivery
Refunds and cancellation rights are explained in our Refund & Cancellation Policy. Delivery of eSIMs, physical SIMs, and related shipping rules are explained in our Shipping & Delivery Policy.
At checkout, you may be asked to expressly request immediate delivery and/or activation of the service before the end of any statutory withdrawal period. Once the service starts, your right to cancel for a refund may be lost or reduced, except where mandatory law provides otherwise.
11. Warranties and liability
To the maximum extent permitted by law, the service is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, error-free, available in every place, or suitable for every device or use case.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or business losses, including loss of profit, loss of revenue, loss of data, loss of opportunity, travel disruption, missed bookings, or loss caused by third-party networks or providers.
To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us for the affected service during the one month before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law, including statutory consumer guarantees or liability for death or personal injury caused by negligence where applicable.
12. Changes to these Terms
We may update these Terms from time to time. Material changes apply from the date they are posted and are not retroactive to charges already incurred. The "Last updated" date shows when the current version took effect.
13. Governing law and language
These Terms are governed by the laws of Estonia, unless mandatory consumer protection rules require otherwise. The courts of Estonia have jurisdiction, without depriving consumers of any mandatory rights or protections available in their country of residence.
The English version of these Terms controls over any translation.
